Governing your use of Loka on iOS, Android, and loka.my.

Welcome to Loka. These Terms & Conditions (the “Terms”) govern your access to and use of Loka - including the Loka mobile app for iOS and Android and our services at loka.my (together, the “Services”) - operated by Planet Loka Global (trading as “Loka” / “Loka.my”) (“Loka”, “we”, “us”, or “our”). By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of the Services. Where a provision applies only to the mobile app or only to the website, we note it. These Terms may be updated periodically, and your continued use constitutes acceptance of the changes.

1.Acceptance of these Terms

By downloading, installing, accessing, or otherwise using the Services, you agree to be legally bound by these Terms and by our Privacy Policy, which is incorporated by reference. These Terms form a binding contract between you and Loka.

1.1 Guests and registered users

Loka uses a soft-gate model:

  • Browsing is open. You may explore destinations, attractions, points of interest, maps, and tours as a guest without creating an account. These Terms apply to you as a guest from the moment you use the Services.
  • Sign-in is required for certain features. Some features - including the AI travel chat, saved itineraries, and your bucket list (saved attractions and tours) - require you to create an account or sign in. By signing in and using these features, you confirm your agreement to these Terms.

1.2 Continued use

Your continued use of the Services after any update to these Terms constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Services and may uninstall the app.

2.Definitions

In these Terms, unless the context requires otherwise:

  • “App” means the Loka mobile application for iOS and Android, including all of its screens, features, content, and updates.
  • “Services” means the features, content, and functionality made available through the App and loka.my, including travel discovery, maps, points of interest, tours, the AI travel chat, saved itineraries, and the bucket list.
  • “Loka”, “we”, “us”, “our” means Planet Loka Global and its successors and permitted assigns.
  • “You”, “your”, “User” means any person who accesses or uses the Services, whether as a guest or a registered Account holder.
  • “Account” means a registered Loka user account created via email and password or via Google Sign-In.
  • “AI Features” means features that use artificial-intelligence or large-language-model technology to generate travel suggestions, itineraries, summaries, and chat responses.
  • “User Content” means any content, input, or information you submit to the Services, including AI chat prompts and messages, saved itineraries, and bucket-list selections.
  • “POI” means a point of interest, attraction, or tour featured in the Services.
  • “Third-Party Services” means external services, content, and providers integrated with or linked from the Services, as described in Section 10.
  • “PDPA” means the Personal Data Protection Act 2010 of Malaysia, as amended from time to time.

3.Eligibility & Age

3.1 Minimum age

You must be at least 18 years of age, or otherwise possess the legal capacity to enter into a binding contract in your jurisdiction, to use the Services or create an Account. If you are under the age of majority in Malaysia or your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

3.2 Compliance with law

You agree to use the Services in compliance with all applicable laws and regulations, including the laws of Malaysia and any local laws applicable at your location. You may not use the Services where doing so would be unlawful.

3.3 Children

The Services are not directed at children, and we do not knowingly collect personal information from children below the applicable age threshold. The Services contain no dedicated child accounts or child-specific age gating. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

4.Accounts & Registration

4.1 Creating an Account

You can create an Account using your email address and a password, or by using Google Sign-In. Authentication and account management are handled through Firebase Authentication and, where you choose it, Google OAuth. When you register, basic account information (such as your email address and a unique user identifier) is processed to operate your Account.

4.2 Accuracy of information

You agree to provide accurate, current, and complete information when creating and maintaining your Account, and to keep it up to date.

4.3 Account security

You are solely responsible for safeguarding your login credentials and for all activities that occur under your Account. You agree to:

  • use a strong, unique password and keep it confidential;
  • not share your credentials or allow others to access the Services through your Account; and
  • notify us promptly if you suspect any unauthorised use of, or security breach affecting, your Account.

We are not liable for any loss or damage arising from your failure to safeguard your Account credentials, except to the extent such loss results directly from our own failure to meet our obligations under applicable law.

4.4 Third-party sign-in

If you sign in using Google, your use of that sign-in method is also subject to Google’s terms and privacy policy. You are responsible for maintaining the security of any third-party account you use to access the Services.

5.Licence to Use Loka

Subject to your compliance with these Terms, Loka grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to download, install, and use the App on a mobile device that you own or control, and to access the website, solely for your personal, non-commercial use.

This licence does not grant you any ownership rights in the Services or their content. All rights not expressly granted to you are reserved by Loka and its licensors. We may suspend or revoke this licence at any time if you breach these Terms.

6.Acceptable Use & Prohibited Conduct

You agree to use the Services responsibly and lawfully. You must not:

  • use the Services for any unauthorised commercial purpose, or resell, redistribute, or exploit the Services or their content without our prior written authorisation;
  • use bots, scrapers, crawlers, spiders, or any automated tools to access, extract, harvest, or index data, content, maps, or POI information from the Services or their underlying systems;
  • copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services or any part of them, except to the extent this restriction is prohibited by applicable law;
  • circumvent, disable, or interfere with any security, authentication, rate-limiting, or access-control feature of the Services or our backend (including the API and authentication tokens);
  • abuse, overload, or attempt to manipulate the AI Features - for example by sending automated, excessive, or high-volume requests; attempting to extract underlying prompts, models, or training data; or attempting to make the AI produce unlawful, harmful, infringing, or deceptive output;
  • interfere with, spoof, or manipulate the Services’ location features, or feed falsified location data to gain an advantage or disrupt the Services;
  • upload, submit, or transmit any content that is unlawful, infringing, defamatory, obscene, harassing, hateful, or that violates the rights of any third party;
  • introduce viruses, malware, or other harmful code, or otherwise disrupt, degrade, or compromise the performance, integrity, or security of the Services, our backend, or any connected service;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
  • use the Services in any manner that violates any applicable law or regulation.

We reserve the right to investigate and take appropriate action - including suspending or terminating your access - against anyone who, in our sole discretion, violates this Section.

7.Your Content & Inputs

7.1 Ownership

You retain ownership of the User Content you create or submit through the Services, including your AI chat prompts and messages, your saved itineraries, and your bucket-list selections. Saved content may be stored locally on your device and/or on our backend so that it is available across your sessions.

7.2 Licence you grant to us

To operate and provide the Services, you grant Loka a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, transmit, and display your User Content for the purposes of operating, maintaining, securing, and improving the Services. This includes sending your AI chat prompts (together with relevant context such as your approximate location and an authentication token identifying your session) to our backend AI/chat service to generate responses. This licence exists only for as long as is necessary to provide the Services and to comply with our legal obligations.

7.3 Your responsibility

You are solely responsible for the User Content you submit. You represent that you have the necessary rights to submit it and that it does not violate these Terms, any law, or the rights of any third party. Do not submit sensitive personal information, confidential information, or content you are not authorised to share into the AI chat or other input fields.

7.4 Feedback

If you send us feedback, suggestions, or ideas about the Services, you agree that we may use them without restriction or obligation to you.

8.AI-Generated Content Disclaimer

Important: please read

The AI travel chat, suggested itineraries, point-of-interest descriptions, and other AI-generated content are produced automatically and may be inaccurate, incomplete, outdated, or misleading. AI output is provided for general information and inspiration only.

You acknowledge and agree that:

  • AI-generated travel suggestions, itineraries, POI information, opening hours, pricing, availability, routes, and answers are not guaranteed to be accurate, complete, or current, and may not reflect real-world conditions;
  • AI output is not professional advice of any kind - it is not booking, financial, safety, security, medical, health, immigration, or legal advice, and must not be relied upon as such;
  • you must independently verify all important details - including bookings, prices, opening hours, transport, entry requirements, health and safety conditions, and travel advisories - directly with the relevant venue, operator, or official source before making any travel decision; and
  • Loka does not warrant the availability, pricing, opening hours, or suitability of any attraction, tour, or destination featured or suggested in the Services.

To the maximum extent permitted by law, Loka is not responsible or liable for any decision you make, or any loss or harm you suffer, in reliance on AI-generated content.

9.Location-Based Services

The Services offer location-based features (for example, showing nearby attractions and providing location context to the AI chat). These features rely on your device’s location services and on third-party mapping providers. By default, the App requests approximate (coarse), city-level location - it does not require continuous, precise GPS tracking to function. If a future feature needs more precise location, the App will request that additional permission separately at the point of use.

  • You control location permissions. The App requests access to your device location, and you may grant, limit, or revoke this permission at any time through your device settings. Some features may not function, or may function with reduced accuracy, if location access is disabled.
  • Foreground use. The App uses your location while you are actively using it to power nearby discovery and location context. It does not run continuous background location tracking.
  • Accuracy is not guaranteed. Location data (whether approximate or, where you grant it, precise) may be inaccurate, delayed, or unavailable due to device, network, environmental, or third-party factors.
  • Not for safety- or navigation-critical use. The location and map features are intended for travel and tourism discovery only. They are not designed for, and must not be relied upon for, emergency response, precise navigation, or any situation where inaccurate, delayed, or unavailable location information could lead to injury, loss, or property damage. Always use dedicated, official tools and services for emergencies and critical navigation.

Maps disclaimer

Maps and geographical data in the Services are provided for travel and tourism purposes only. They do not serve any legal, administrative, surveying, or boundary-determination function, and should not be used or interpreted as authoritative for those purposes.

10.Third-Party Services & Data

The Services integrate with and rely on third-party services to function. These currently include:

Your use of these Third-Party Services is also governed by their own terms of service and privacy policies. Loka does not control, and is not responsible for, the content, accuracy, availability, practices, or policies of any third-party service, website, or resource - including any external links surfaced in the Services. Your dealings with any third party are solely between you and that third party.

Where the Services pass data to a third-party service (for example, your approximate location to a mapping provider, or your sign-in details to an authentication provider) they do so to deliver the features you request. For details of what data we process and how, please see our Privacy Policy.

What the mobile app does not do

The Loka app does not integrate any third-party analytics, advertising, or crash-reporting SDK, and it does not process payments in-app. The mobile app therefore does not share your data with advertising or analytics networks.

11.Privacy & Data Protection

Your privacy matters to us. Our collection, use, disclosure, and protection of your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference and forms part of your agreement with us. Please read it carefully.

We process your personal data in accordance with the Personal Data Protection Act 2010 of Malaysia, as amended (the “PDPA”) and other applicable data-protection laws. In summary, and as further described in the Privacy Policy:

  • the personal data the Services process includes your account information (such as email address and a unique user identifier), your approximate location, your AI chat inputs, and content you save (itineraries and bucket-list selections);
  • we process this data to operate your Account, deliver location-based discovery, generate AI responses, and save your content across sessions;
  • you have rights under the PDPA (as amended), including the rights to access and correct your personal data, to withdraw consent (which may limit features), to limit the processing of your personal data, and to data portability where technically feasible, by contacting us using the details in Section 23; and
  • while we take reasonable technical and organisational measures to protect your data, no method of transmission over the internet or method of electronic storage is completely secure, and you should take standard precautions such as using strong passwords and trusted, secure connections.

If anything in these Terms appears to conflict with our Privacy Policy in relation to the handling of personal data, the Privacy Policy governs that subject matter.

12.Intellectual Property

The Services and all of their content - including the “Loka” and “Loka.my” names and branding, logos, text, graphics, icons, user interface, maps, software, and the selection and arrangement of content - are the intellectual property of Loka or its licensors, and are protected under applicable copyright, trademark, and other intellectual-property laws.

Except for the limited licence granted in Section 5, nothing in these Terms transfers any intellectual-property right to you. You may not use, copy, reproduce, distribute, or create derivative works from any Loka content or branding without our prior written consent, except as expressly permitted by law.

Reporting infringement. If you believe any content in the Services infringes your copyright, trademark, or other intellectual-property rights, please contact us at hello@loka.my with enough detail to identify the content and the right you rely on. We will review valid notices and take appropriate action, which may include removing the content.

13.Fees, Purchases & Subscriptions

The Services are currently free to use. As at the effective date of these Terms, we do not charge for use of the core Services, and the App does not integrate any in-app purchase, subscription, or third-party payment processor within the mobile app.

Certain AI or backend Services may be subject to fair-use quotas or usage limits (for example, a limit on the number of AI chat requests). If such a limit is reached, the relevant feature may temporarily return a message and become unavailable until the limit resets or is increased. We reserve the right to introduce paid features, subscriptions, usage limits, or credits in the future. Where we introduce any paid feature, we will present its price and terms before you incur a charge, and your purchase will be subject to those additional terms.

If paid features are introduced

Any purchases made through the Apple App Store or Google Play will be processed by Apple or Google under their respective payment terms, billing rules, and refund policies. Loka does not control app-store billing, and refunds for app-store purchases are governed by the relevant store’s policy.

14.Service Availability, Changes & Updates

The Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that they will be available at any particular time or location.

We reserve the right, at our sole discretion and with or without prior notice, to:

  • modify, enhance, update, suspend, or discontinue the Services or any feature or part of them;
  • impose limits on certain features or restrict access to parts of the Services; and
  • release updates that you may need to install in order to continue using the App.

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Services or any part of them.

15.Disclaimers of Warranties

To the maximum extent permitted by applicable law, the Services and all content (including AI-generated content, maps, location data, and POI information) are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory.

We expressly disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Services will meet your requirements, that content will be accurate or reliable, or that defects will be corrected. Any reliance you place on the Services is at your own risk.

Loka content is provided on a best-effort basis

The travel content in the Services - including attraction, point-of-interest, and tour information, descriptions, opening hours, pricing, categories, locations, and maps - is compiled and maintained on a best-effort basis from a range of sources and may be incomplete, out of date, or inaccurate. We do not warrant or guarantee the accuracy, completeness, currency, or availability of any such content, and you should independently verify important details directly with the relevant venue, operator, or official source before relying on them or making any travel decision.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under the laws of Malaysia, including any non-excludable rights you may have under the Consumer Protection Act 1999.

16.Limitation of Liability

To the maximum extent permitted by applicable law, Loka, its directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Services - even if we have been advised of the possibility of such damages.

Without limiting the above, Loka shall not be liable for any loss or damage arising from: (a) your reliance on AI-generated content, maps, location data, or POI information; (b) any travel decision, booking, or activity undertaken in reliance on the Services; (c) the acts, omissions, content, or services of any third party; or (d) any inaccuracy, interruption, or unavailability of the Services.

To the extent any liability cannot be excluded, our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the greater of (i) the total amount you have paid to Loka in the twelve (12) months preceding the event giving rise to the claim, or (ii) RM 100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of Malaysia.

17.Indemnification

You agree to indemnify, defend, and hold harmless Loka and its directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use or misuse of the Services; (b) your User Content; (c) your breach of these Terms or any applicable law; or (d) your violation of the rights of any third party.

18.Termination & Suspension

18.1 By you

You may stop using the Services at any time and may uninstall the App from your device. You may request closure of your Account by contacting us. Saved content stored on your device is removed when you uninstall the App; signing out clears locally stored, user-scoped data from the device.

Account deletion

You can delete your Account at any time directly in the App (Settings → Delete Account), or by contacting us at the address in Section 23. Deleting your Account permanently removes your account-scoped personal data held on our backend (including synced itineraries, bucket list, and chat history), subject to any data we are required to retain to comply with legal obligations. We handle deletion in line with applicable law, including the PDPA, and with the Apple App Store and Google Play account-deletion requirements.

18.2 By Loka

We may suspend or terminate your access to the Services or your Account, in whole or in part, at our sole discretion, with or without notice, if we reasonably believe that you have breached these Terms, that your use poses a security or legal risk, or as otherwise required by law.

18.3 Effect of termination

Upon termination, the licence granted in Section 5 ends and you must stop using the Services. Sections that by their nature should survive termination - including Sections 7, 8, 11, 12, 15, 16, 17, 20, and 23 - will continue to apply.

19.Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services, our practices, or legal requirements. When we make changes, we will update the “Last updated” date at the top of this document and, where the changes are material, we will provide additional notice within the App or by other reasonable means.

Your continued use of the Services after the updated Terms take effect constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Services.

20.Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict-of-laws principles. You agree that all legal matters and disputes arising out of or in connection with these Terms or the Services shall be resolved in the courts of Malaysia, to whose jurisdiction you irrevocably submit.

Before commencing any formal proceedings, you agree to first contact us in good faith using the details in Section 23 so that we may attempt to resolve the matter informally.

21.App-Store-Specific Terms (Apple & Google)

You may download the App from the Apple App Store or Google Play. The following additional terms apply to those distributions and, in the event of any conflict with the rest of these Terms in respect of an app-store download, these app-store terms prevail solely to the extent of that conflict.

21.1 Apple App Store Additional Terms

These terms apply when you obtain the App from Apple’s App Store:

  • Agreement is with Loka, not Apple. These Terms are concluded between you and Loka only, and not with Apple Inc. (“Apple”). Loka, not Apple, is solely responsible for the App and its content.
  • Scope of licence. The licence granted to you in these Terms for the App is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where permitted by Apple.
  • Maintenance and support. Apple has no obligation whatsoever to provide any maintenance or support services for the App. Any maintenance or support is provided by Loka.
  • Warranty. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; beyond that, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Loka’s responsibility.
  • Product claims. Loka, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar legislation.
  • Intellectual-property claims. In the event of any third-party claim that the App or your use of it infringes that third party’s intellectual-property rights, Loka, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of such claim.
  • Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer name and address. Any questions, complaints, or claims with respect to the App should be directed to Loka using the contact details in Section 23.
  • Third-party beneficiary. You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

21.2 Google Play Note

If you obtain the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App. To the extent of any conflict between these Terms and the Google Play Terms of Service in respect of a Google Play download, the Google Play Terms of Service govern that conflict, but only to that extent.

22.General Provisions

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Loka regarding the Services and supersede any prior agreements on that subject.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign or transfer these Terms without our consent. We may assign our rights and obligations under these Terms, for example in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
  • Privacy. Our collection and use of your personal data is described in our Privacy Policy and in Section 11, which form part of your agreement with us.
